This agreement serves as a legal contract between you and bluecom.ai, and governs your use of all bluecom.ai services (the Services). By accessing and using our Services, you agree to be bound by all of the terms and conditions set forth in this Agreement, as well as the bluecom.ai Privacy Policy. We reserve the right to modify this Agreement at any time by posting a revised version on our website. Your continued use of our Services after such modifications constitutes your acceptance of the revised Agreement. You acknowledge that the terms of use set forth in this Agreement are supported by reasonable and valuable consideration, which includes your use of bluecom.ai Services. By agreeing to these terms, you acknowledge receipt of such consideration and its adequacy.

Eligibility & Registration

a. Eligibility: In order to use our Services, you must be at and at least eighteen (18) years of age.

b. Registration: To use the Services, you must complete the registration form either on your behalf or on behalf of the corporation, partnership or other legal entity that will be using the Services. By accepting this Agreement, you represent that you are authorized to sign and bind the corporation, partnership or other legal entity. You agree to provide accurate, complete and current registration information and to update it as needed to ensure that it remains accurate, complete and current.

Privacy

At bluecom.ai, we take the privacy of our users seriously. We encourage you to review our Privacy Policy to understand our commitment to protecting your personal information and how we use and disclose it. Additionally, if you receive information about another bluecom.ai user through our Service, you must keep all information confidential and not use or disclose it for marketing purposes without express written authorization from both bluecom.ai and the user whose information you received.

Intellectual Property

All of the logos, domain names, website content, and other intellectual property associated with our products and services are the sole property of bluecom.ai. Any unauthorized use, copying, imitation, modification, alteration, or amendment of our intellectual property is strictly prohibited without our prior written consent. We take intellectual property infringement very seriously and will take legal action against any individuals or entities found to be in violation of this policy.

User Conduct

By utilizing our Services, you are bound by the following terms: You must adhere to all laws, regulations, ordinances, and statutes relevant to the use of our Services. It is forbidden to use our Services for fraudulent or illegal activities or promote such activities. It is also prohibited to infringe upon the rights of third parties, including trademark, copyright, patent, trade secret, intellectual property, contractual rights, privacy, publicity, or confidentiality obligations. You must abide by all agreements you have with third parties, including eBay. You are not permitted to interfere with the proper functioning of the bluecom.ai website or any transactions conducted on the website using any device, software, or routine. You must not take any action that places an undue or disproportionate burden on our infrastructure or hinders our ability to provide the Services. You must not post any material that contains viruses or other damaging components, or otherwise tampers with or impairs the bluecom.ai website. You are not allowed to collect, copy, reproduce, alter, modify, create derivative works, or publicly display any content or information from the bluecom.ai website without prior written consent from bluecom.ai and the relevant third-party. You must not use any automatic device or routine, such as robots or spiders, to access or interact with the bluecom.ai website. The information, data, text, graphics, photographs, images, or other materials you provide to bluecom.ai or other users of our Services, including information acquired through eBay via the Services (such as email addresses, user IDs, passwords), is your sole responsibility. By utilizing the bluecom.ai Services, you acknowledge that bluecom.ai is only acting passively as a provider of online storage, distribution, and publication of your materials. You must only utilize the allocated space in the Image Library for storing images utilized in advertisements placed via the Services. By using the Services and the bluecom.ai website, you give bluecom.ai the right to access, monitor, remove, modify, or disable access to any or all of your materials at any time at the sole discretion of bluecom.ai. bluecom.ai cannot guarantee that other users will comply with the User Conduct rules or other provisions in this Agreement. As between you and bluecom.ai, you are responsible for any harm or injury resulting from any such lack of compliance.

Passwords & Security

It is your responsibility to keep your usernames and passwords confidential. If there is any security breach through your account, you must promptly change your password. You also agree to release bluecom.ai from any claims arising from a compromised account security. Additionally, you agree to protect bluecom.ai from any financial damages or intellectual property losses resulting from a breach of confidentiality, by indemnifying and defending the company.

Fees & Payment Terms

By using our Services, you agree to be responsible for paying all fees and taxes associated with their use. A monthly membership fee covers the use of all Services provided by bluecom.ai. Any changes to the fees or payment terms will be effective immediately, and it is your responsibility to check for any such changes. To pay bluecom.ai invoices, you must set up automatic payments through a credit card accepted by bluecom.ai, and all payment information will be stored by bluecom.ai. You may also choose to prepay for a minimum of 12 months through our annual plan. Failure to make timely payments may result in the immediate termination of all Services at the sole discretion of bluecom.ai. In the event of failed payment or overdue accounts, we reserve the right to use other collection mechanisms, including the retention of collection agencies and legal counsel to pursue payment.

Abuse, Suspension, Termination

As per the agreement, bluecom.ai has the right to limit, suspend, or terminate your user account(s) and access to our Services without notice and for any reason. This action may be taken if we suspect that you are abusing our services, violating our terms and conditions, creating problems or potential legal liabilities, infringing on intellectual property rights of bluecom.ai, its affiliates or third parties, or acting inconsistently with our policies or the spirit of our policies. If bluecom.ai decides to limit, suspend or terminate your account, all amount paid to bluecom.ai are non-refundable. Therefore, it is important to follow the terms and conditions of this Agreement and use our Services responsibly to avoid any such consequences.

Cancellation

We reserve the right to cancel all inactive accounts at our sole discretion and without notice.
